General Terms and Conditions – LucaCarMods
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: the period within which the consumer may exercise the right of withdrawal.
Consumer: a natural person who is not acting for purposes related to their trade, business or profession.
Day: calendar day.
Continuous performance contract: an agreement relating to the regular delivery of products and/or services.
Durable data carrier: any means that enables the consumer to store information in a way that allows future consultation and unchanged reproduction.
Right of withdrawal: the possibility for the consumer to withdraw from the agreement within the cooling-off period.
Entrepreneur: LucaCarMods.
Distance contract: an agreement concluded without the simultaneous physical presence of consumer and entrepreneur.

Article 3 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded.
Before the contract is concluded, the text of these terms and conditions will be made available to the consumer.
If one or more provisions are void or cancelled, the remaining provisions will remain fully in force.
Any ambiguities regarding the interpretation of these terms shall be interpreted in favor of the consumer.
Article 4 – The Offer
The offer contains a complete and accurate description of the products and/or services offered.
Images represent the products as accurately as possible, but colors may vary.
Obvious mistakes or errors in the offer are not binding on the entrepreneur.
All prices include VAT and exclude shipping costs unless stated otherwise.
Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer.
The entrepreneurs confirm the agreement electronically.
The entrepreneur may refuse an order if there are valid reasons to do so.
Every agreement is concluded subject to sufficient availability.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the agreement within 14 days without giving any reason.
The cooling-off period starts on the day after the consumer receives the product.
The consumer may use the model withdrawal form but is not obliged to do so. Withdrawal may also be communicated in another unambiguous manner, for example by email.
During the cooling-off period, the consumer shall handle the product and packaging with care.
Article 7 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer unless stated otherwise.
The entrepreneur will refund all payments received from the consumer, including standard delivery costs, within 14 days after the consumer has notified the withdrawal.
The entrepreneur may withhold reimbursement until the product has been received or until the consumer provides proof of return shipment, whichever occurs first.
Additional costs resulting from a more expensive delivery method chosen by the consumer will not be refunded.
The consumer is only liable for any diminished value of the product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for products:

manufactured according to the consumer's specifications

clearly of a personal nature
-
hygienic products whose seal has been broken
provided this is clearly stated in the offer.
Article 9 – The Price
Prices will not be increased during the validity period of the offer, except for changes due to legal regulations.
All prices include VAT.
Printing and typographical errors are reserved.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that the products comply with the agreement and the reasonable expectations of the consumer.
Any defects must be reported within a reasonable period after discovery.
Any warranty provided by the entrepreneur does not affect the statutory rights of the consumer.
The entrepreneur does not guarantee suitability for a specific purpose unless expressly agreed.
Article 11 – Delivery and Performance
Delivery takes place at the address provided by the consumer.
Orders will be delivered within 30 days at the latest, unless agreed otherwise.
If delivery is delayed, the consumer has the right to terminate the agreement free of charge.
Compensation for damages is excluded, except in cases of intent or gross negligence by the entrepreneur.
The risk of damage or loss remains with the entrepreneur until delivery to the consumer.
Article 12 – Continuous Performance Contracts
The consumer may terminate agreements concluded for an indefinite period at any time with a notice period of no more than one month.
Article 13 – Payment
Payment must be made immediately upon placing the order using the available payment methods.
The consumer is obliged to report inaccuracies in payment details without delay.
In the event of non-payment, the entrepreneur is entitled to charge statutory collection costs.
Article 14 – Complaints Procedure
Complaints should preferably be submitted within 10 days of discovery and must be fully and clearly described.
The entrepreneur will respond within 14 days after receiving the complaint.
If no solution is reached, the consumer may refer the dispute to Stichting WebwinkelKeur or the European ODR platform:

Article 15 – Disputes
All agreements to which these terms apply are exclusively governed by Dutch law. The Vienna Sales Convention is excluded.
Article 16 – Additional Provisions
Additional or deviating provisions may not be to the detriment of the consumer and must be recorded in writing.
